Re-queen weak hive?

I've got a hive that seems to be just barely surviving.  Lots of old drawn comb on the frames that is very dark and has brood that appears will never hatch.  The queen doesn't seem to be laying much. 

How do I know if the queen is laying or it's workers laying?

I think that I'm going to just re-queen and see if my old queen that is in there is the problem. 

Should I replace a lot of this old comb with new duraglit foundation and let them draw new, or will that be too much work for them as a weak hive? 

I also have a thriving hive, should I just add a frame of brood to my weak hive and let them make their own queen after I dispose of the old one?  When adding a frame of brood, do I add brood, bees and all? or will that cause some problems?

Go in and find the queen or look for spotty eggs that are laid on the sides of the cell and usually two or more at a time.

Check for laying workers first or they will kill the introed queen.

That will set them back some...how old is "old"

Thanks for the replies.  I'm not sure how old the comb is.  I bought these existing hives.  When I brought them home, one is bursting at the seams, working on filling their 2nd super now and the other has headed in the opposite direction. 

The comb appears very dark and they are only using a little bit.  I'm really not sure whether to replace the frames and let them draw new comb with the new queen.  Will this be too stressful on such a weak hive?  I've only got about 2-3 frames of bees in a single 10 frame deep.

A week ago I pulled two frames of brood from my strong hive to use in a couple of trap outs, so I would like to give it sufficient time before robbing another frame.
