Thankfully our code enforcement officers have been reigned in some here

Since it is the county, you are good. If you start getting harassed, call David Westervelt or Adam Putnam. They will put a stop to it. This is why the state took over control of beekeeping.

If it were I, I'd try to get something in writing from the state people.

Indian river county is the one that is giving me issues. No word from anyone today but I have an inspection tomorrow

BeeMaster2

What type of inspection is it. If he is not the bee inspector doing the inspection, I would request the bee inspector bee present.

It will be inspected by Florida bee inspector Caitlin. The inspector originally for my area recently quit to move to better and better so Caitlin is taking her place until they find a new one

Caitlin is a sweetheart....very knowledgeable tell her hi from Jeff down in the Key Largo :-)

Is this something the county requested? Its an odd time of year to do inspections.

I am due for an inspection in August, but she said since I am having issues that she would inspect now so when they talk to the county, they can better vouch for me.

Jeff,
The key word she used was government body. A home owners association is not a government body.
Jim
Governmental agencies control zoning. Homeowners may add more stringent regulations but he control over land use and zoning rests with the governing body.

Perhaps it is different in FL but here in AZ HMOs can make their own rules including crazy stuff like no American Flags, pickup trucks, etc... Yes I am in property management and have been for 27 years and have been involved in plenty of court cases where the owner or HMO always wins. You sign a contract when moving in and are bound by that....

More and more HOA rules are being voided...several in Florida where landscaping restrictions have been overturned. It wouldn't surprise me to see a beekeeping case come up in the future where the keeper follows all of the state of Florida guidelines and the HOA regulations are overturned.

I live in the country where there is no HOA. If I ever buy another house and move it will not be to a place with an HOA. If I find a house I like in an HOA I will tell the owner "Sorry hire Dexheimer to move the house out of the HOA and I will be interested." Funny... The only real business in my town other than the gas station moves buildings.

Well the inspection went great and so was Caitlin. Even gave you a shout out Jeff. So the state is happy with my site but the county is still saying that I can't keep the bees. So the fight marches on.

BeeMaster2

TBL,
State verses local will not bee much of a fight. You're good.

Well good news I finally got a hold of the county again after my inspection and was told the county is going to drop the matter and close the case. I get to keep my bees. I know many have said not worry but when it's your bees they want to take it is nerve racking. thanks to all that gave good advise.

Local inspector and I had a conversation on this just recently. Her statement to me was that NO governmental body in Florida supercedes the states control on Where and how bees can be kept. 50x100 lot I am allowed 3 hives during the year and up to 6 during swarm season....There are set back regulations and other considerations but those are ONLY enforceable at the state level. No other agency can issue a citation concerning beekeeping according to her.

I'm still trying to found out where the number of hives "per acre" is coming from. I didn't read that in the statute. Can anyone point me to the source?

numbers may be increased up to 12 colonies as a swarm control measure for not more than a
60 day period of time.
