Pest Control Poisoned my trap out!

i am talking to chappy but it was in the city of gainsville

If the city authorized it then the pest control fella was paid as a contractor to perform the work. There should be a paper trail for all of this beginning with some sort of contract and ending with a cancelled check or automatic deposit.............all of which would be public information.

As far as ownership of the property past the sidewalk........well that becomes a game of "how it is worded". The deed to our place says we own to the center of the road, BUT there is a 25' utility easement from the center of the road also. there is a big difference between a right of way and a utility easement.
those hot bees will have you steppin and a fetchin like your heads on fire and your keister is a catchin!!!

Bees will be bees and do as they please!

Florida law now allows registered beekeeper to do trap outs and removals. The law is on your side.

were the bees on the homeowner's side of the sidewalk or between the sidewalk & the street? if on the property side neither the city or the pest control should have any right to access the property without prior permission. trees between the sidewalk & street are often controlled by the city. it depends on the town. as far as the pest control guy; beekeepers not knowing how to do trap-outs might be his stated opinion but it is not the law & usually is not true. I'd pursue the facts as far as whether the city of gainsville initiated this. if there is no proof I'd pursue the trespass & theft angle so this chump does not do this again. I'd get my nuc back 1st before stirring up the pot though.

By the way our state has designated honey bee as livestock.
we are no longer under pest control rules for trap outs.
this happened in Florida correct. then it is time to get police involved whether or not the city asked for the removal!
You see there is statutes for horse thieves car thieves and now with the designation livestock, bees are now protected on any property.
under any condition, other than AHB's.
take lots of pictures now get samples of dead bees. if the city asked demand recompense by the city. as they do not know the changes in the laws. and instigated this action.
By the way ignorance of the law is no defense in any state. they will hold all to there standards. therefore we must demand and require them to adhere to laws as well.
IF IN FLORIDA DO NOT BACK DOWN.

Someone should tell him we don't need to be pro pest people as bees are not pests. in Australia they are livestock same as cattle and sheep so the stock squad would be called.

But seriouslly. we have rights and to be infringed upon goes against our grain as Americans. Keep following the paper trail. If not there, than call a LEO and charge the pesticide company with theft at least and if you can get the home owner involved, than trespassing and destroying poperty, malicious intent, (the trap-out was there, he has FB stating that he doesnt agree with this..blah blah blah) theres enough there to throw a good scare in and get restitution.

File a police report of stolen property (the bee box).  Tell the officer that you know who took it.  Put pressure on the guy so he does not do it again and gives your box back.

well after about a week and a half i got amy nook back a few bees not many no apolagy john sent his son with it his son said his dad new i was poed but when the city says do it they have to well sounde like a lot of yes men to me but what can you do and besides in g ville if you report a trap gone missing they would tell you it was probely for the best thanks for all your help

Glad you got it back. Sorry about the loss of the bees. At least he was embarassed enough to make his son return it.
